Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Scrier mobile app and related services (together, the "Service") provided by Charles Bushrow ("we", "us"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 17 years old to use the Service. By creating an account, you represent that you meet this requirement and that the information you provide is accurate.
2. Your account
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at scrier.support@gmail.com if you suspect unauthorized access.
3. What Scrier is — and is not
Scrier is a journaling and accountability tool for stock picks. It is not a brokerage, financial advisor, or registered investment adviser. We do not execute trades, hold securities or funds, or recommend any specific investment.
Nothing in the Service is investment, legal, tax, or accounting advice. All picks, theses, comments, and reactions are user-generated and reflect only the views of the individual who posted them. You are solely responsible for your own investment decisions and any consequences they produce.
4. User-generated content
You retain ownership of the picks, theses, comments, reactions, avatars, and group icons you submit ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute Your Content for the purpose of operating the Service — for example, showing your picks to the groups you've shared them with. This license ends when you delete Your Content or your account, except for backups retained for the period described in our Privacy Policy.
You agree not to submit content that:
- is unlawful, fraudulent, defamatory, or threatening;
- harasses, abuses, or impersonates another person or entity;
- infringes any third party's intellectual property or privacy;
- contains hate speech, sexually explicit material, or content that exploits or endangers minors;
- is malware, spam, or designed to harm the Service or other users;
- markets securities, solicits investments, or impersonates a registered financial professional.
5. Reporting and moderation
We do not pre-screen user-generated content, but we have zero tolerance for objectionable material and abusive behavior. You can report offending content using the in-app Report option on any pick or comment, or email scrier.support@gmail.com.
We will review reports and take appropriate action — which may include removing content and terminating the offending user's account — within 24 hours of receiving a credible report.
You can also block other users from the app, which hides their picks and comments from your view across all shared groups.
6. Immutable picks
By design, once a pick is submitted with a real entry price, the entry price, ticker, position type, and thesis are permanent and cannot be edited by anyone, including us. This is a feature of the Service, not a defect. If you make a mistake, you can close the pick; the original record remains.
7. Market data
Market prices are provided by Tiingo and are used under our license with them. Prices may be delayed, inaccurate, or unavailable from time to time. We do not warrant the accuracy, completeness, or timeliness of any market data displayed in the Service, and we are not liable for actions you take based on it.
8. Acceptable use
You agree not to:
- access the Service through automated means or scrape its data;
- attempt to circumvent the immutability of pick records or any security mechanism;
- resell, sublicense, or commercialize the Service;
- interfere with the Service's operation or other users' enjoyment of it.
9. Termination
You may delete your account at any time from the Profile screen. We may suspend or terminate your access to the Service at our discretion, with or without notice, including for violations of these Terms.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed US$100.
12. Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in New York County, New York.
13. Changes
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and notify users in-app on next launch. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
